Terms and conditions
1. Registration

The written registration serves as a contract between the registering person and This Side Up. The number of spots for the This Side Up Tour is limited. Registrations will be processed in the order in which they are received. Your registration is valid and binding for all parties once you submit the form and agree to these terms and conditions.
2. Prices

2.1 Inclusions
The tour price includes full board with breakfast, lunch, and dinner from the camping kitchen. All camping overnight stays and unlimited water are also included.

2.2 Exclusions
Not included in the tour price are flights, hotel stays, external meals, canned and alcoholic beverages.
Flights are not included to allow for a flexible and risk-free decision on the tour’s execution. You may book your flight at any time, but we kindly ask you to do so through MTI Maya Travel Inn, as they know all our travel details and ensure that we are all in Windhoek at the right time. In case of a flight disruption, MTI acts as a single point of contact. If you book your flight elsewhere, we will not be able to assist you if something goes wrong. If you miss the departure and didn’t book through MTI, the full price remains due.
During the trip, we will offer a selection of canned and alcoholic drinks for you to enjoy, including sundowners. At the end of the tour, we will settle these drinks using a points system. You can decide how many points to assign based on your consumption compared to others, and we will charge you accordingly. -
2.3 Payment Conditions
No payment is due upon initial registration. Final confirmation of the tour will be made 14 days prior to departure. If the tour proceeds, the full amount is due before departure. If the tour is canceled, all claims are void, ensuring a risk-free registration. Key factors for the decision are the number of registrations and the COVID-19 situation. If quarantine is required or entry requirements are uncertain, the tour will not proceed.

2.4 Price Changes
In the event of new taxes, extreme fluctuations in flight and accommodation prices, or other unforeseen circumstances, the prices may change. We will notify you of any necessary price adjustments no later than 14 days before departure. If a price increase exceeds 10%, you may withdraw from the contract within 3 days of notification.

2.5 Small Groups
The advertised price assumes a minimum number of participants. If this number is not met, price increases may apply. In such a case, you may cancel without charge if you do not agree with the new price.
3. Accommodations

The price is based on double occupancy in rooms/tents. Single travelers will be paired with others of the same gender unless a single room/tent is requested for an additional charge. If no suitable roommate can be found, no additional charge will apply.
4. Cancellation, Rebooking, and Trip Interruptions

4.1 Cancellation by the Customer
If you are unable to participate, you must notify This Side Up in writing. Cancellation fees are as follows:
- Before the decision of tour execution: 0% of the total price
- After the decision of tour execution: 40% of the total price
- Less than 10 days before departure: 100% of the total price

4.2 Cancellation by This Side Up
This Side Up reserves the right to change services or cancel the tour due to unforeseen circumstances, such as strikes, governmental actions, or force majeure. Any additional costs incurred will be passed on to you. Cancellation due to force majeure (e.g., natural disasters, epidemics, etc.) is typically covered by your personal travel insurance.

4.3 Abandonment by Participants
If you must leave the tour early, unutilized services will only be refunded if they have already been paid by This Side Up. Additional travel costs are your responsibility or will be covered by your return travel insurance.
5. Insurance

The package price does not include personal insurance. Costs for evacuation flights, emergency returns, illness, etc., are your responsibility or will be covered by your personal insurance. We strongly recommend verifying your coverage and obtaining cancellation and return insurance if necessary.
6. Entry Documents

You are responsible for ensuring compliance with passport, visa, and vaccination requirements. We will inform you in advance about the necessary documents. This Side Up assumes no liability for expired or missing documents.
7. Liability

7.1 General
The This Side Up Tour is carefully researched and organized with professional partners in the travel and safari industry.

7.2 Liability Limitation
For property or financial damages, liability is limited to a maximum of the total tour price per person.

7.3 Liability Exclusion
This Side Up is not responsible for changes to the itinerary caused by weather conditions, government measures, force majeure, delays by third parties, strikes, vehicle breakdowns, etc. We are also not liable for damages caused by wild animals, natural events, diseases, lost vacation days, or personal negligence.

7.4 Personal Injury
In the case of personal injury (death, bodily harm), we will assume liability if the damages result from non-fulfillment of the contract by This Side Up or their agents. Compensation for incidents related to flight or other transportation is limited by applicable international agreements or national laws.

7.5 Local Events
This Side Up assumes no responsibility for activities, events, or excursions booked independently by you during the tour.
8. Complaints

If you have any complaints, they must be reported to the tour leader during the trip. A written report will be made. Complaints must be submitted in writing within 30 days after the tour concludes.
9. Security of Customer Funds

This Side Up is not responsible for flights booked independently. However, it ensures the security of funds for the tour itself (excluding flights).
10. Jurisdiction

Swiss law applies to the legal relationship between you and This Side Up. Any legal proceedings will be conducted in the jurisdiction of Schaffhausen.
